Terms of Service

These Terms of Service form a binding contract between you and {{COMPANY_NAME}} ("SomaVue", "we", "us", "our"). By creating an account, starting a free trial, paying for a subscription, or otherwise using SomaVue, you agree to these Terms. Please read Section 13 (Arbitration and Class-Action Waiver) carefully — it affects how disputes are resolved.
1. About SomaVue
SomaVue is an educational web application that lets users explore reference ranges, practitioner notes, and peer-reviewed correlations across blood-laboratory markers. SomaVue is provided "as is" as an educational tool and is not a medical device, healthcare service, or substitute for professional medical advice. See the Medical Disclaimer, which is incorporated by reference into these Terms.
2. Eligibility and account
You must be at least 18 years old, capable of forming a binding contract under applicable law, and not barred from receiving services under the laws of the United States or any other applicable jurisdiction. By using SomaVue you represent and warrant that you meet these requirements.
You are responsible for maintaining the confidentiality of the email address used for sign-in (SomaVue uses passwordless magic-link authentication). You are responsible for all activity that occurs through your account. Notify us immediately at support@aquariansolution.com if you suspect unauthorized access.
3. License to use SomaVue
Subject to your compliance with these Terms, SomaVue grants you a limited, non-exclusive, non-transferable, revocable license to access and use SomaVue for your personal, non-commercial educational use, or — for Clinic-tier subscribers — for use within a single licensed practice as expressly permitted by the applicable plan. This license terminates automatically when your subscription ends or when these Terms are terminated.
4. Subscriptions and trials
SomaVue currently offers three tiers:

Pricing, included features, and trial terms may change for new sign-ups. We will not change the pricing of an existing active subscription without giving you at least 30 days' notice by email or in-app, after which the change applies on your next renewal.
5. Billing, renewals, and refunds
Payment processor. SomaVue uses Stripe, Inc. as its payment processor. By providing a payment method you agree to Stripe's terms (stripe.com/legal) in addition to these Terms. SomaVue does not see or store your full card number.
Trial. Paid plans begin with a 14-day free trial. You will be charged automatically at the end of the trial unless you cancel before it ends. We send a reminder email approximately 3 days before the trial ends.
Renewals. Subscriptions renew automatically each month at the then-current rate until cancelled. Renewals are charged to your payment method on file.
Failed payments. If a renewal payment fails, your access to paid features may be suspended until payment is updated. If payment is not received within a reasonable period, your subscription will be cancelled.
Refunds. Except where required by law, payments are non-refundable. We may, at our sole discretion, offer pro-rated refunds for unused portions of a billing period in cases of extended service outage or genuine error. To request a refund, contact support@aquariansolution.com within 14 days of the charge.
Taxes. Listed prices do not include sales, use, value-added, GST, or similar taxes, which may be added at checkout depending on your billing address.
6. Cancellation
You can cancel at any time from the "Manage billing" link in your account, which routes to the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period — you keep paid access until that period ends, and you will not be charged again. Cancelling before the trial ends prevents the first charge. We do not pro-rate partial months.
7. Your content and inputs
SomaVue is designed so that your laboratory values and any text you enter remain on your device — they are not transmitted to or stored by SomaVue's servers. The data SomaVue does store on its servers is limited to: your email address, your subscription tier, your Stripe customer and subscription identifiers, and metadata necessary to operate the service. See the Privacy Policy for details.
You retain all rights to information you enter. You grant SomaVue no license to your laboratory data because SomaVue does not receive it. To the extent you submit feedback or correspondence to SomaVue, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and incorporate that feedback into the service without compensation.
8. Prohibited use
You agree not to:
- Use SomaVue to provide medical advice, diagnose disease, or otherwise practice medicine, dietetics, naturopathy, or any other regulated profession in any jurisdiction where you are not licensed to do so.
- Resell, sublicense, or commercially exploit SomaVue or its content beyond the scope of the license granted in Section 3.
- Reverse-engineer, decompile, or attempt to extract the source code, datasets, or model logic underlying SomaVue, except to the limited extent permitted by applicable law that cannot be waived by agreement.
- Scrape, mass-download, or systematically copy SomaVue's content, ranges, notes, or correlation databases.
- Circumvent, disable, or otherwise interfere with security, access controls, paywall gating, or rate limits.
- Use SomaVue to harass, defame, or harm any person, or to violate any law, including export-control or sanctions laws.
- Upload or transmit malware, exploit vulnerabilities, or perform unauthorized testing.
9. Intellectual property
SomaVue, including its software, design, copy, datasets, range tables, practitioner-note text, and correlation summaries, is owned by {{COMPANY_NAME}} or its licensors and is protected by copyright, trademark, and other intellectual-property laws. Cited third-party studies and external resources remain the property of their respective owners. The "SomaVue" name and logo are trademarks of {{COMPANY_NAME}}. No rights are granted to you except as expressly set out in these Terms.
10. Disclaimer of warranties
SomaVue is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, SomaVue and its operators disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, availability, freedom from errors or harmful components, and any warranty arising from course of dealing or trade usage.
SomaVue does not warrant that the service will meet your requirements, will be uninterrupted, secure, or error-free, or that any laboratory range, practitioner note, correlation, or citation is accurate, current, or complete. SomaVue is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease.
11. Limitation of liability
To the maximum extent permitted by law, in no event will SomaVue, its operators, owners, contributors, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including without limitation damages for personal injury, lost profits, lost data, lost goodwill, business interruption, or substitute services — arising out of or relating to your use of, or inability to use, SomaVue, even if advised of the possibility of such damages and regardless of the theory of liability (contract, tort, strict liability, or otherwise).
In no event will SomaVue's aggregate liability arising out of or relating to these Terms or the service exceed the greater of (a) the total amount you paid SomaVue in the twelve months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions the limitations above apply to the maximum extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless SomaVue and its operators, owners, contributors, employees, contractors, and affiliates from and against any third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of SomaVue; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) your reliance on, or any decision made on the basis of, content from SomaVue, including any health, dietary, supplement, or treatment decision.
13. Arbitration and class-action waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before filing any formal proceeding, you and SomaVue agree to attempt to resolve any dispute informally for at least 60 days by contacting support@aquariansolution.com with a written description of the dispute and the relief requested.
Binding arbitration. If informal resolution fails, you and SomaVue agree that any dispute, claim, or controversy arising out of or relating to these Terms or to SomaVue (including its formation, breach, termination, validity, or enforceability) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The seat of arbitration will be Wilmington, Delaware. The arbitration may be conducted by telephone, video, or written submissions where permitted by AAA rules. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and SomaVue each agree that any dispute will be brought in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate or join more than one person's claims and may not preside over any form of representative or class proceeding.
Exceptions. Either party may bring an individual action in small-claims court for any qualifying claim. Either party may seek injunctive or equitable relief in court for infringement or misuse of intellectual property.
Opt-out. You may opt out of this arbitration agreement by sending written notice to support@aquariansolution.com within 30 days of first accepting these Terms. Your notice must include your name, the email associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provision of these Terms.
14. Governing law and venue
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to Section 13, the exclusive venue for any dispute that may be brought in court is the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will notify active subscribers by email or in-app at least 14 days before it takes effect. Your continued use of SomaVue after the effective date of an updated version constitutes acceptance. If you do not agree to the updated Terms, your remedy is to cancel your subscription before the effective date.
16. Termination
We may suspend or terminate your access to SomaVue at any time, with or without notice, for any reason, including suspected violation of these Terms, suspected fraud, non-payment, or extended inactivity. On termination, your license under Section 3 ends, and Sections 7, 9, 10, 11, 12, 13, 14, and 17 survive.
17. Miscellaneous
Entire agreement. These Terms, the Medical Disclaimer, and the Privacy Policy are the entire agreement between you and SomaVue and supersede any prior agreement on the same subject.
Severability. If any provision is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be replaced with one that most closely reflects the original intent.
No waiver. Failure to enforce any provision is not a waiver of the right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force majeure. Neither party is liable for delays caused by events beyond reasonable control, including natural disasters, network or infrastructure outages, government actions, or labor disputes.
No agency. No partnership, joint venture, employment, or agency relationship is created by these Terms.
Notice. We may give notice by email to the address on your account. You may give notice by email to support@aquariansolution.com.
